Frequently Asked Questions
Does registering my company name with the MCA also protect it as a trademark?
No. Company name approval by the MCA and trademark registration are entirely separate processes under different Acts and regulators. An MCA-approved company name gives you zero trademark protection — someone else can still register that name (or something similar) as a trademark, and you would have no right to stop them without your own registration.
What is the difference between ™ and ®?
You can use ™ next to your mark as soon as you file an application, to signal it's claimed. The ® symbol is legally reserved for marks that have completed registration and received a Certificate of Registration from the Trade Marks Registry — using ® before that is not permitted.
How long does trademark registration take?
If unopposed, typically 8-18 months from filing to registration — this includes examination, a mandatory 4-month opposition window after Journal publication, and Registry processing time. Formal filing itself (TM-A) is usually completed within a few days.
What happens if my application is objected to?
The Registry issues an Examination Report listing the objection (e.g. similarity to an existing mark, or descriptiveness). You get an opportunity to respond in writing, and if needed, attend a hearing. Our team drafts the response and represents your application through this stage.
How long is a registered trademark valid?
10 years from the date of registration, and it can be renewed for further periods of 10 years indefinitely — there's no cap on the number of renewals, as long as you file on time.
Do I get a fee discount as a startup or individual?
Yes. The government filing fee is ₹4,500 per class for individuals, sole proprietors, Startup-recognized entities, and MSMEs, compared to ₹9,000 per class for other applicants — a 50% concession, provided you submit the relevant Startup/MSME certificate.
